VRYSTAAT. – Die Bloemfontein-hooggeregshof het ’n interdik teen Patricia Morgan-Mashale toegestaan, nadat die nasionale vervolgingsgesag (NVG) haar hof toe geneem het oor beweerde lasterlike uitlatings op sosiale media.
Volgens Kaizer Kganyago, die NVG se nasionale woordvoerder, het die hof bevind dat haar plasings vals, onregmatig en skadelik was en dat dit die waardigheid van die nasionale direkteur van openbare vervolgings (NDOV) geskend het.
Die hof het beveel dat Morgan-Mashale onmiddellik moet ophou om enige verdere bewerings of kommentaar oor die NVG en sy amptenare te publiseer. Sy moet ook haar oorspronklike Facebook-plasings verwyder en binne sewe dae ’n formele verskoning aan die NDOV, betrokke aanklaers en ander NVG-amptenare plaas. Die verskoning moet vir 60 dae sigbaar bly en sy moet ook die regskoste betaal.
Die saak spruit uit plasings wat sy in 2025 gemaak het waarin sy aanklaers in die Vrystaat van korrupsie en omkopery beskuldig het. Hierdie bewerings het verband gehou met ’n spesifieke saak waaraan die kantoor gewerk het. Die NVG sê sy is herhaaldelik gevra om bewyse vir haar bewerings te lewer en ’n ondersoeker is selfs aangestel om haar inligting te toets. Sy kon egter nooit enige bewys voorlê nie, maar het voortgegaan om die aantygings te versprei. ’n Formele waarskuwingsbrief is ook aan haar gestuur om op te hou met die plasings, maar sy het dit geïgnoreer, wat uiteindelik tot die hofsaak gelei het. Die NVG het aangedui dat hulle Morgan-Mashale se sosiale media sal monitor om seker te maak dat sy aan die hofbevel voldoen.
Andy Mothibi, die nasionale direkteur van openbare vervolgings, het gesê hoewel vryheid van spraak belangrik is, moet dit nie gebruik word om ander se waardigheid te skaad nie. Hy het beklemtoon dat die NVG sy aanklaers sal beskerm deur alle beskikbare regsmiddele te gebruik.
Morgan Mashale het kort gelede die volgende op sosiale media gedeel: “I hereby wish to inform you that your investigation officer from the NPA Ethics Committee has misled you.
He informed you that I never gave him any evidence, but he underestimated me, I keep records of EVERYTHING, even my till slips.
In the pictures are screenshots of our conversations and evidence that I shared all the documents with him, affidavits, bank statements, receipts, letters, names of witnesses that he should contact, everything.
I also fascilitated a meeting between himself, Maj-General Adams and the lawyers of Zwelinzima Joseph Qnuru. He met with General Adams, who gave him more documents, but he never bothered to meet with Zweli or his lawyer.
He informed me that he shared all the evidence with IDAC and promised that he will facilitate a meeting between us. That never happened, because after that, he just disappeared and didn’t answer my calls anymore.
So, taking me to Court is a golden opportunity to go and present all the evidence in a Court of law and to call Zweli as a witness, it’s high time that all this information should be exposed on the relevant platform. In fact, it’s long overdue.
Maj-General Adams will confirm that as a result of this information, the murder docket of the late Ms Seipati Lechoano was reopened, the dockets of the stolen vehicles and firearms of the South African National Defence Force was reopened, two firearms and a laptop was recovered, the docket of the late Daniel Shezi, who was killed by farmers in 1997 was recovered and currently DPCI has taken over all the investigations, relating to the information that Zweli exposed.
All I can say is that I will not apologise or delete any posts, I need to meet with you in the Free State High Court, it’s very important that this evidence should be shared with the general public.
By the way, when are you going to serve me with the court order? You have published this all over the media, but you “forgot” to serve me with the actual court order?
