GAUTENG. – Fredrick Pieter Jacobus Botha (44) from Vanderbijlpark has been sentenced to life imprisonment for the premeditated murder of farmer Christian van Tonder.
Lumka Mahanjana, NPA spokesperson, says the Pretoria High Court also sentenced Botha to ten years direct imprisonment for stock theft, seven years for possession of an unlicensed firearm and three years for possession of ammunition. The court ordered that these sentences be served concurrently with the life sentence.
Van Tonder sold 31 cattle to Botha on 29 November 2021. After Botha took possession of the cattle, he allegedly asked Van Tonder to accompany him in Van Tonder's vehicle to a remote area near the Theoville farms at Barrage to settle payment for the livestock. Upon arrival at the location, Botha shot Van Tonder, who was sitting in his bakkie. Members of the Barrage neighbourhood watch later discovered the vehicle with Van Tonder's body inside that same day and reported the incident to police. After an extensive investigation, Botha was taken into custody on 29 August 2023.
Botha pleaded not guilty during the trial to all charges and denied any involvement in the crimes. The state prosecutor, Advocate Jeniffer Cronje, however presented evidence that proved his guilt beyond reasonable doubt. During sentencing proceedings, Botha's legal representative requested the court to deviate from the prescribed minimum sentence. It was argued among other things that four permanent employees depend on him and that he provides financial support to his wife, children, mother-in-law and father. Cronje opposed the request.
