WES-KAAP.

A formal statement by Yacoob Yachts on the incident that occurred on 31 December 2023

On the 29th of December 2023, during a cruise from 13h00 to 14h00 along the Green Point coastline towards Granger Bay, 20 kayaks, accompanied by two kayak guides, paddled out of the bay towards the Jolly Roger. The Jolly Roger was cruising at a speed of 600 revs and upon sight of the kayaks, the Skipper immediately shifted the engine into neutral to ensure the safety of both the Jolly Roger passengers and the kayakers.

The kayaks were scattered over the bay and largely formed into three groups. The first group, accompanied by the two guides, started taking photos of the Jolly Roger. The second group of three kayaks positioned themselves on the starboard side along the coastline. The third group, independent from the others, paddled towards Granger Bay.

After confirming with the crew standing on the front of the boat that the bow was clear, the Skipper engaged the engines to proceed towards Granger Bay. However, a lone kayaker (on a two-seated kayak) started moving towards the Jolly Roger’s bow at which stage the Skipper was alerted. It shifted the engine once again into neutral. The kayaker then jumped off the kayak about 5 metres from the vessel and the empty kayak bumped into the Jolly Roger. Only after ensuring that the kayaker was not harmed and was safely onboard another kayak, and that the kayak was not damaged, did the Skipper proceed to the V&A Waterfront.

Navigation rules, often called ‘rules of the road at sea’, apply to all vessels and give clear indications about passing, approaching, giving way and overtaking other vessels. Smaller vessels are not allowed to approach larger vessels and are not allowed to cross the bows of larger vessels. It must be noted that the kayaks approached the Jolly Roger and that the vessel did not deliberately approach the kayaks.

Yacoob Yachts has been operating for 25 years and has qualified and experienced crew on its vessels. The commercial-qualified Skipper who chartered the Jolly Roger during this cruise also underwent a kayak guide course and therefore would at all times adhere to the safety protocols and responsible practices for both the clients on the Jolly Roger and the clients on the kayaks.

We trust this statement presents Yacoob Yachts position on the matter.

Sincerely,

Jillian Grindley-Ferris
