Before the Honourable Judge Barthus, Cape Town, 5 June 2026.
Having read the documents filed of record and having heard counsel for the Applicant, IT IS ORDERED THAT:
1. The Respondent is hereby placed under the provisional liquidation in the hands of the Master of the above Honourable Court as envisaged by Chapter 14 of the Companies Act, 61 of 1973 (as amended).
2. A rule nisi is issued calling upon the respondent and all person interested to appear and show cause, if any, to this Honourable Court at 10h00 on 07 September 2026 why:
2.1. the Respondent should not be placed under final liquidation; and
2.2. the costs of this application should not be costs in the liquidation.
3. Service of this Order shall be effected:
3.1. by the Sheriff on the Respondent at its principal place of business;
3.2. by the Sheriff on the Respondent’s employees at the Respondent’s principal place of business;
3.3. by the Sheriff on any trade union representing the employees at the Respondent’s principal place of business;
3.4. by one publication in each of the Government Gazette and “Nuusflits” online news paper;
3.5. by hand on the South African Revenue Services at Lower Long Street, Cape Town; and
3.6. by hand on the Master of the High Court at Castle Street, Cape Town.
4. The costs of this application shall be the costs in the winding-up of the Respondent.
