MOHOMED SADICK ALLI — FIRST APPLICANT (Identity Number: 711125 5174 086)
And
WAHEEDA ALLI — SECOND APPLICANT (Identity Number: 730929 0165 081)
TAKE NOTICE that the abovenamed First and Second Applicants (‘the Applicants’) intend to make application to this Honourable Court on the 28th day of July 2026 at 09h30 or so soon thereafter as the matter may be heard for an order in the following terms:
1) That the Applicants be and are hereby granted leave to change their matrimonial property system from one in community of property to one out of community of property in terms of the notarial contract annexed to the First Applicant’s Founding Affidavit, marked ‘B’ (‘the notarial contract’);
2) That the new matrimonial system shall be effective from the date of the registration of the notarial contract;
3) That the Registrar of Deeds, KwaZulu-Natal be and is hereby authorized to register the notarial contract.
TAKE NOTICE FURTHER THAT the Affidavit of the First Applicant, together with the supporting annexures thereto, as well as the Confirmatory Affidavit of the Second Applicant, will be used in support of this Application.
TAKE NOTICE FURTHER THAT the Applicants have appointed GOSAI & COMPANY INCORPORATED, 105, 6th Avenue, Morningside, Durban, at which address the Applicants will accept notice and service in these proceedings.
KINDLY PLACE THE MATTER ON THE ROLL FOR HEARING.
